Advisory and revised registration guidelines for Indian associations in Kuwait


ADVISORY AND REVISED REGISTRATION GUIDELINES FOR INDIAN ASSOCIATIONS IN KUWAIT

 

1. Expatriate Associations in Kuwait are governed under the relevant Rules & Regulations of the Ministry of Labour & Social Affairs, Government of Kuwait. The Indian Associations have to respect and comply with them.

 

2. Registration of the associations by the Embassy of India is an acknowledgement of their presence and functioning, and is not an assumption of any responsibility by the embassy for their activities; and the responsibility lies entirely with the office-bearers of the associations. Registration is subject to the guidelines set by the embassy from time to time, and is voluntary. Further, Registration is not to be deemed by the associations as a substitute for compliance with Kuwaiti laws.

 

3. The Embassy of India, Kuwait, is fully conscious of the diversity of the Indian Diaspora in Kuwait, and their cultural and professional yearnings, and the need for suitable avenues in the form of meaningful and responsible associations within the confines of the Kuwaiti law.

 

4. The Embassy is also conscious that the Government of Kuwait has displayed tremendous confidence and trust in the law-abiding nature of the Indian expatriate community, and this is an important factor behind its being the largest expatriate population in Kuwait. The Embassy has an obligation towards ensuring responsible community activity that is in the larger interests of the entire membership of the associations concerned, while also being mindful at all times of the Indian Government’s friendly relations with Kuwait. In this context, the quality and vibrancy of the activities of the associations should be the guiding principle, and the quantity/number of associations is not a true measure of it.

 

5. The embassy, therefore, has to maintain a reasonable balance between the essence and spirit behind an association, and the number of associations registered with it at any given point of time, taking into consideration - the sensitivities of the host government and the trust and confidence it has reposed in the community; solidarity and cohesion of the community; the nature/purpose of each association; and avoidance of duplication/overlap.

 

6. The main objective and rationale of the registered associations is to provide a platform for the members and their families to be able to come together as cohesive groups for cultural/professional/sports purposes.

 

7. The Embassy, as part of its responsibilities, undertakes a review of various associations from time to time. This is an ongoing process. In the latest review, it has found in case of a majority of the associations that either the validity of their Registration has expired or they have become defunct; in respect of some others, there have been no meaningful activities; and a few remaining ones have been deviating from the terms of the registration including indulging in commercial activities, misrepresentation of membership details etc. The list on the website has been amended accordingly, and those associations desirous of renewing/reviving their registration may feel free to contact the embassy if they wish.

 

8. In this context, the following Revised Guidelines are put in place for registration. These guidelines have to be read together with the above Advisory:

  • i. The Embassy reserves the right to accept/reject the Application for Registration based on its merits which should be consistent with the above purpose, spirit and rationale. A minimum 500 adult (18 years or above) members (who are not counted in the membership of other associations) would be the general norm for accepting an application for consideration. While the number of members is relevant, embassy is conscious of the need for flexibility.
  • ii. The validity of registration is for 3 years, but the Embassy reserves the right to revisit and review the registration status at any time during the validity period. Revalidation is not automatic.
  • iii. The embassy will not be able to entertain applications from Residents’ and Alumni etc. associations or on the basis of smaller administrative units such as cities/towns/districts etc. Professional organizations such as Indian doctors, engineers, lawyers, business persons, Chartered Accountants, Nurses etc. are admissible and considered on case to case basis.
  • iv. No application for a new association will be entertained unless the applying association has been in existence for at least 2 years with noteworthy contribution to its members.
  • v. Embassy’s registration is accorded under the understanding that the associations will undertake their activities from within their own membership resources. Embassy’s registration is not a permission for collection or soliciting of funds from general public etc.
  • vi. Any activity which is commercial in nature is not permitted.
  • vii. There should be a written constitution/by-laws of the association, regular annual AGMs, change of office-bearers on a periodical basis in a democratic fashion, ideally every year or 2 years at the least. Inability to pass on the baton can/will be interpreted as lack of participatory membership and can be adequate grounds for annulment of registration. Similarly, misrepresentation of details will lead to immediate cancellation of registration.
  • viii. Applications may be addressed to the Community Associations Section of the embassy, by way of a duly signed letter by both the President and the Secretary (in original), briefly explaining the basic purpose and rationale behind the association, and covering different aspects/elements indicated in this document. No email requests will be entertained. If found eligible to be considered in preliminary scrutiny, the embassy will seek further information in prescribed proforma.
